General terms and conditions of sale
These General Terms and Conditions of Sale (hereinafter GTC) govern all distance selling activities concluded by the company TISSUSHOP SARL (hereinafter referred to as Tissushop) with any consumer and non-professional buyer (hereinafter referred to as the customer) using the website www.tissushop.fr (hereinafter referred to as the website).
These Terms and Conditions of Sale constitute the entire agreement between the parties. The Customer is therefore deemed to have accepted them without reservation. Any order placed on the Website implies the Customer's unreserved acceptance of these Terms and Conditions of Sale. By validating their order, the Customer confirms their acceptance of all the Terms and Conditions of Sale.
The Customer and Tissushop agree that these Terms and Conditions govern their relationship exclusively. Tissushop reserves the right to modify these Terms and Conditions at any time for future orders and without prior notice. They will be applicable as soon as they are published online. The version applicable to the Customer's purchase is the one in effect on the website on the date the order is created and registered, regardless of the payment date. The Customer is therefore advised to consult them before each order and/or use of the website.
In the event of silence in these Terms and Conditions, French legal provisions shall apply .
Definitions:
- Finished product: refers to any finished item that cannot be personalized by the Customer and does not require any specific cutting .
- Cut product: refers to any item requiring cutting according to the instructions provided by the Customer when placing their order. Therefore, Tissushop requires a minimum of 1 meter when purchasing fabrics or haberdashery items by the cut, and this applies to all fabrics unless otherwise stated on the product page.
- Custom-made clothing: refers to any item made via Tissushop at the request of the Customer and according to the instructions given by the Customer.
Cut Products and Custom-Made Products constitute goods made according to the Customer's specifications or clearly personalized within the meaning of Article L.221-28 of the Consumer Code.
Article 1
1.1.
The purpose of these General Terms and Conditions is, in particular, to define the rights and obligations of the Parties in the context of the online sale of goods and/or provision of services offered by Tissushop to its Customers.
1.2.
These terms and conditions apply to purchases made by customers on the website www.tissushop.fr, located in France. For deliveries to countries not listed on the website, please contact Tissushop customer service, who will review your request as soon as possible.

Article 2 - Product Description
2.1.
The products governed by these Terms and Conditions are those listed on the Tissushop website. They are offered subject to actual stock availability.
2.2.
Each product listed on the website has a product page detailing its essential characteristics: the price including all taxes, its composition and size, and the estimated shipping time from our warehouse. Products are described and presented as accurately as possible. However, Tissushop cannot be held liable for any errors or omissions in this presentation.
The Customer is solely responsible for the choice of products, their compatibility with the intended use, as well as compliance with the instructions for maintenance, washing, cutting and use.
TISSUSHOP cannot be held responsible for improper or unsuitable use of the products, nor for the consequences resulting from incorrect handling, transformation or manufacturing carried out by the Customer.
2.3.
Photographs and images are provided for illustrative purposes only. Variations in color, texture, pattern, or appearance may occur, particularly due to screen settings, dye baths, production batches, or the inherent nature of the textile fibers. These variations, within industry tolerances, do not constitute a defect. Product photographs displayed on the website are not contractual.
The customer is advised to order a sample before purchasing any fabric to ensure the product meets their expectations.
Article 3 - Price
3.1.
Tissushop reserves the right to change its prices at any time but undertakes to apply the prices in effect at the time of the order, subject to the availability of the products on that date.
3.2.
Prices are shown in euros. They do not include delivery charges, which are billed separately and shown before order confirmation. Prices include VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the prices of products in the online store. Full payment is due at the time of ordering. Under no circumstances will payments be considered as deposits or down payments.
3.3.
If one or more taxes or contributions, particularly environmental ones, were to be created or modified, whether increased or decreased, this change may be passed on to the selling price of the products.
Article 4 – Sales unit and minimum purchase quantity
4.1.
The products sold on the site are sold either by the linear meter, by the unit, or by the whole piece.
For products sold by the linear meter, the minimum purchase is 1 meter. Beyond 1 meter, it is possible to order in increments of 0.50 meters. If the buyer enters a quantity to add to the cart that is less than 0.50 meters, the quantity actually added to the cart will be automatically adjusted by the system to 0.50 meters.
For products sold individually, the minimum purchase is 1 unit, the value of which is indicated in meters. Any subsequent units are added in the same proportions as the unit represented by the initial full piece. If the buyer enters a quantity to add to the cart that is less than the quantity of a full piece, the system will automatically adjust the quantity actually added to the cart.
For products sold individually, the minimum purchase is 1 unit. Beyond 1 unit, it is possible to order in increments of 1 unit. If the buyer enters a quantity less than 1 unit to add to the cart, the quantity actually added to the cart will be automatically adjusted by the system to 1 unit.
4.2.
When multiple quantities of the same item are added to the cart, they are automatically added together, regardless of the length. The prices shown on the website do not include a flat rate for multiple cuts of the same item. If the customer wishes to request specific cuts, they must contact Customer Service, who will provide a quote tailored to that service.
Article 5 - Order
5.1.
The Customer can place their order online, using the online catalog and the form provided on the website. Order acceptance and confirmation are completed by entering data on successive pages. To submit an order, the Customer must have created an account.
5.2.
To create an account, the Customer must complete an online registration form including email address, last name, first name, phone number, date of birth, password, and billing address. The Customer agrees to provide accurate, up-to-date, and complete information about their identity. In particular, they agree not to create a false identity or impersonate another legal entity or individual. A confirmation email will be sent to the Customer upon creation of their personal account, containing their login credentials and the password they chose according to Tissushop's security criteria. If the Customer forgets their password, they can request a new one through their account by clicking on the forgotten password link. The Customer may deactivate their account at any time by contacting Customer Service using the contact information provided above (see 1.2) by mail or email. In the event of non-compliance with the obligations arising from the acceptance of these General Terms and Conditions of Sale, payment incidents, provision of erroneous information when creating the account or actions likely to harm the interests of Tissushop, the latter reserves the right to block or cancel the order and to suspend access to the services offered on the Website until the problem is resolved.
5.3.
By confirming the order, the Customer accepts these General Terms and Conditions of Sale without reservation. They must also choose the delivery address and method, and finally confirm the payment method.
5.4.
All orders constitute acceptance of the prices and descriptions of the products available for sale. Any dispute regarding this will be addressed within the framework of a possible exchange and the guarantees mentioned below. All orders are firm and final once the customer has made payment.
5.5.
In certain cases, particularly in the event of non-payment, an incorrect address, or another issue with the customer's account, Tissushop reserves the right to hold the customer's order until the problem is resolved. If no solution is found, Tissushop reserves the right to cancel the order in question.
5.6.
In the event that the ordered product is unavailable or out of stock, the Customer will be informed immediately by email. A replacement product will be offered; if this is not suitable for the customer, the order for that product will be cancelled and a refund will be issued via the same payment method used to place the order, or via a credit note valid for one year. The remainder of the order will remain valid and binding.5.7.

5.8.
Any order submitted by mail in paper format will be processed manually by Tissushop's Customer Service department. If the ordered product is unavailable or out of stock, the Customer will be informed immediately using the same contact method provided when placing their order by mail. A replacement product will be offered; if this replacement is not suitable, the order for that product will be canceled and a refund will be issued via the same payment method used to place the order, or via a credit note valid for one year. The remainder of the order will remain valid and binding.
Article 6 - Payment Method
6.1.
To pay for their order, the Customer must pay for their purchases in euros. The Customer has the following payment options:
- bank card (CB, VISA, Mastercard)
- Bank transfer: the bank details will be provided to the customer in the order confirmation email. The customer makes a bank transfer, indicating the order number in the transfer details. All fees associated with this payment method are the responsibility of the buyer. Payment by bank transfer must be made within 15 days of the order date; otherwise, Tissushop will cancel the order without notifying the customer.
- French bank check: The Customer must send a French check made payable to TISSUSHOP SARL, along with a printed copy of the order confirmation. A 10-day processing period will be applied before the order is shipped. Payment by check must be made within 15 days of the order date; otherwise, Tissushop will cancel the order without notifying the Customer.
- For PayPal , the customer must first have a personal PayPal account . A processing fee of 3.50% of the order amount will be automatically applied with this payment method.
6.2.
The Customer warrants to Tissushop that they have the necessary authorization to use the payment method chosen when validating the order. Tissushop reserves the right to suspend order processing and delivery in the event of a payment authorization refusal by officially accredited organizations or in the event of non-payment. Tissushop specifically reserves the right to refuse to make a delivery or fulfill an order from a Customer who has not fully or partially paid for a previous order or with whom a payment dispute is pending. Tissushop has implemented an order verification procedure to ensure that no one uses another person's bank details without their knowledge. As part of this verification, Tissushop may contact the Customer by any means to validate the transaction and may, if necessary, request a copy of their identity document and proof of address. The Customer must provide the requested supporting documents within fifteen (15) business days of Tissushop receiving the request. The order will only be validated after Tissushop has received and verified all the requested documents. Upon receipt of all the requested supporting documents and if Tissushop confirms the order, the time required to transmit and receive the requested documents from the Customer will delay the delivery of the product(s) accordingly, which the Customer expressly accepts and acknowledges. The Customer is hereby informed that any delay, failure, or refusal to provide the requested supporting documents within the specified timeframe will result in Tissushop canceling the order.
Article 7 - Transaction
7.1.
The communication of the Customer's bank card number via the online form and the final validation of the order shall constitute proof of the Customer's agreement in accordance with Article 1366 of the Civil Code and shall be considered as follows:
- payment of sums due under the purchase order,
- signature and express acceptance of all transactions carried out.
7.2.
In the event of fraudulent use of the bank card, the Customer is invited, as soon as this use is noticed, to contact Tissushop customer service at 03.66.72.89.34 (cost of a local call) from Monday to Friday from 9:00 a.m. to 12:30 p.m. and from 1:30 p.m. to 5:00 p.m. or by email at contact@tissushop.fr.
7.3.
The computerized records, stored in Tissushop's computer systems under reasonable security conditions, will be considered proof of communications, orders, and payments between the parties. Order forms and invoices are archived on a reliable and durable medium that can be produced as evidence.
7.4.
Tissushop sends the Customer an order confirmation by automatic email.
7.5.
Pursuant to Articles 2367 et seq. of the Civil Code, Tissushop retains ownership of the delivered products until full payment has been received from the Customer, regardless of the date of delivery of the order.
Article 8 - Delivery Terms
8.1.
Delivery can only be made after confirmation of payment by Tissushop's banking institution.
8.2.
The delivery time will not exceed sixty (60) business days from the order confirmation date. Tissushop may provide shorter estimated delivery times prior to the conclusion of the contract. Ordered products are delivered using the methods offered by Tissushop at the time the product(s) are ordered, and according to the delivery method chosen and confirmed by the Customer.
For your information, Tissushop offers the following delivery methods:
Free delivery in Metropolitan France, excluding islands and mountain areas, to a relay point from €69 of purchase including VAT, and €100 to home, within the limits of the dimensions authorized by the carrier and any additional costs for rolls.
Free delivery to a collection point for orders over €100 including VAT in Germany, Belgium, Luxembourg, and the Netherlands.
Free delivery to a collection point for orders over €150 for other European Union countries (excluding islands) , within the limits of the dimensions authorized by the carrier and any additional costs for rolls.
• Home delivery via tracked green letter:
Tissushop reserves this shipping method for orders of small samples or fabric remnants, within the size limits defined by the postal service. This option is only available for countries offering home delivery tracking.

• Metropolitan France: Delivery to a GLS network collection point:
Cost of this delivery method: €6.90 for orders under €69 (including VAT) and free for orders of €69 or more (including VAT), excluding islands and mountain areas. 8.3.
The seller undertakes to make its best efforts to deliver the products ordered by the Customer within the aforementioned timeframes. However, if the orders have not been delivered within the maximum delivery period, the Customer may terminate the contract, provided that Tissushop has first been formally notified by registered letter with acknowledgment of receipt, requesting delivery or provision of the service within a reasonable additional period. The sums paid by the Customer will then be refunded no later than fourteen (14) days following the date of termination of the contract, excluding any compensation or deductions. Nevertheless, Tissushop shall not be held liable to the Customer for any delivery delay not exceeding the maximum delivery period.
8.4.
Products are delivered to the address indicated by the Customer on the order form; the Customer is responsible for ensuring its accuracy. Any package returned to Tissushop due to an incorrect or incomplete delivery address will be reshipped at the Customer's expense. The Customer may only specify one delivery address for their entire order. Tissushop may, at the Customer's request, send the invoice to a billing address instead of the delivery address; to do so, the Customer must select the corresponding option on the order form. No deliveries are made to campsites, hotels, or post offices.
8.5.
If the Customer is absent on the day of delivery, the delivery person will leave a delivery notice in the mailbox, which will allow the package to be collected at the place and during the time indicated according to the chosen carrier.
8.6.
The goods travel at Tissushop's risk, in accordance with Article L216-4 of the French Consumer Code. However, the Customer must check the condition of the items upon delivery. If the original packaging is damaged, torn, or open, the Customer must inform Tissushop within two (2) business days of receiving the item(s), providing all supporting documentation (including photos) by email to contact@tissushop.fr, or by registered mail to: Tissushop - Customer Service – 79 rue Sadi Carnot – 59280 ARMENTIERES, France.
8.7.
The verification of the goods is considered to have been carried out once the Customer, or a person authorized by him, has signed the delivery note without making any reservations on the carrier's receipt.
8.8.
If products need to be returned to Tissushop due to a manufacturing defect, a return request must be submitted to Tissushop within 14 (fourteen) days of delivery. Any claim made after this period will not be accepted.
8.9.
For deliveries outside the European Union, the customer may be subject to import duties and taxes, which are levied in the destination country. Any additional customs clearance fees will be the customer's responsibility; Tissushop has no control over these fees. Customs policies vary significantly from country to country, so the customer should contact their local customs office beforehand for further information. Furthermore, please note that when you place an order on our website, you are considered the official importer and must comply with all laws and regulations of the country to which you are having the products delivered. International shipments are subject to being opened and inspected by customs authorities.
8.10.
When the customer does not receive their order within the timeframe specified by the shipping company (which varies depending on the chosen carrier), the order will be returned to Tissushop.
Tissushop's sales department will contact the customer to arrange for redelivery. The customer will be responsible for both the return shipping costs and the actual reshipping costs. In the event of an order cancellation, the return shipping costs incurred by Tissushop will be deducted from the refund amount for the products, provided the products meet the return conditions detailed below.
The customer has six months to take possession of their order; after this period, the order will be considered abandoned. Tissushop then reserves the right to resell the product or donate it to charities. Return
shipping costs vary depending on the chosen carrier. The shipping company reserves the right to modify the shipping terms and conditions at any time.
Return costs are a flat rate of €10.80 including tax per parcel at Chronopost or based on actual weight at GLS , Colissimo and independent carriers.
Article 9 - Delivery Errors
9.1.
The Customer must make any claim of delivery error to Tissushop no later than fourteen (14) days following the day of delivery, in relation to the information appearing on the order form.
9.2.

9.3.
Any claim not made in accordance with the rules defined above and within the specified time limits will not be taken into account and will release Tissushop from all liability towards the Customer, except for legal guarantees.
9.4.
Upon receipt of the complaint, the Customer will receive an email from Tissushop confirming that their complaint has been received. Tissushop will then offer either a credit note valid for one year or a refund via the same payment method initially chosen by the Customer.
9.5.
In case of delivery error, the Customer will receive a prepaid label to affix to the package to return it to Tissushop's address.
Article 10 - Returns, right of withdrawal
10.1.
In accordance with the provisions of the Consumer Code, the Customer has 14 (fourteen) working days from the day after the delivery date of their order to exercise their right of withdrawal by email to contact@tissushop.fr . Following the instructions provided by email, the Customer will have 14 (fourteen) days to return any finished product (as defined in the preliminary article herein) that does not suit them and request a full refund without penalty, except for the return shipping costs, which remain the Customer's responsibility.
10.2.
However, it is specified that, in accordance with Article L.221-28 of the French Consumer Code, clearly personalized products are EXCLUDED from this right of withdrawal. These products are: - Cut Products: referring to any item requiring cutting - And Custom-Made Products: referring to any item made via Tissushop at the Customer's request and according to the Customer's specifications. NO WITHDRAWAL PERIOD IS ALLOWED FOR THESE CLEARLY PERSONALIZED PRODUCTS.
10.3.
Only products returned complete, in their original, undamaged packaging, and in perfect condition for resale will be accepted. Any product that has been damaged or used, or whose original packaging has been damaged, will not be refunded.
Article 11 - Return Procedure - Refund
11.1.
After notifying the Customer of their decision to withdraw, and provided this withdrawal is accepted in accordance with Article 10 above, the Customer then has 14 (fourteen) days to return the products following the procedure provided by email. Cut Products, Made-to-Measure Clothing, sewing patterns, and magazines are not eligible for exchange or refund.
11.2.
The product(s) must be returned to Tissushop, complete, in perfect condition for resale, and in their original packaging, along with the original order number, by mail with proof of delivery, to the following address: Tissushop Customer Service, 79 rue Sadi Carnot, 59280 ARMENTIERES, France
11.3.
This right of withdrawal, when applicable, may be exercised without penalty, it being understood that the return shipping costs are borne by the Customer. Tissushop will not accept any packages sent with postage due. For orders shipped with free shipping, if the order total after the return of one or more items no longer qualifies for free shipping, a flat fee corresponding to the shipping costs will be deducted from the refund amount (depending on the carrier chosen by the Customer).
11.4.
Tissushop will reimburse the Customer for the full amount corresponding to the returned items within 14 (fourteen) days of the date the package is returned. The Customer is strongly advised to keep proof of postage for the packages.
Article 12 - Guarantees
12.1
Tissushop guarantees, in accordance with applicable legal provisions, the Customer against any hidden defect and lack of conformity arising from a defect in material, design or manufacturing affecting the delivered products and rendering them unfit for use.
12.2.
In accordance with legal provisions, the Customer has two (2) years from the date of delivery of the goods to take action against Tissushop. They may choose between repair or replacement of their order. However, the seller may refuse the buyer's choice if it entails a cost that is clearly disproportionate to the other option, taking into account the value of the goods or the significance of the defect. In such a case, the seller is obligated to proceed, unless impossible, according to the option not chosen by the buyer. The Customer is not required to provide proof of the existence of the lack of conformity during the twenty-four months following delivery of the goods. The legal guarantee of conformity applies independently of the commercial guarantee. The Customer may also choose to invoke the guarantee against hidden defects in accordance with Article 1641 of the French Civil Code; in this case, they may choose
between rescission of the sale or a reduction in the sale price in accordance with Article 1644 of the French Civil Code.
12.3.
Any warranty, contractual and/or legal, is excluded in the event of misuse, use for professional purposes, negligence or lack of maintenance by the Customer, as well as in the event of normal wear and tear of the goods, accident or force majeure, or if the Customer has undertaken, on their own initiative, repair or modification work on the products.
12.4.
The Customer is expressly informed that Tissushop is not the producer of the products presented within the meaning of Articles 1245 et seq. relating to liability for defective products.
Article 13 - Force Majeure
13.1.
Any circumstances beyond the control of the Parties that prevent the performance of their obligations under normal conditions shall be considered as grounds for exemption from the Parties' obligations and shall result in their suspension.
13.2.
The Party invoking the circumstances referred to above must immediately notify the other party of their occurrence, as well as their disappearance.
13.3.
Force majeure shall be defined as any irresistible event or circumstance beyond the control of the Parties, unforeseeable, unavoidable, and independent of the will of the Parties, which cannot be prevented by them despite all reasonable efforts. Specifically, in addition to those typically recognized by French courts, the following shall be considered force majeure or fortuitous events: blockages of transportation or supply routes, earthquakes, fires, storms, floods, lightning, and the disruption of telecommunications networks or difficulties specific to telecommunications networks external to the client.
13.4.
The Parties will consult to examine the impact of the event and agree on the conditions under which the performance of the contract will continue. If the force majeure event lasts for more than three months, these general terms and conditions may be terminated by the affected party by sending a formal notice by registered letter with acknowledgment of receipt.
Article 14 - Processing of personal data
14.1.
The personal data collected within the framework of the parties' commercial relations is intended to enable, in particular, the registration and processing of customer orders, to respond to requests for information and to ensure the management of the customer file.
14.2.
The data will be kept by the various Tissushop departments for the time necessary to fulfill the purposes described above.
14.3.
The person whose personal data has been collected has the right to access, rectify, erase, limit processing, as well as the right to object to processing and data portability, in accordance with the provisions of the General Data Protection Regulation of April 27, 2016.
14.4.
The data subject may withdraw their consent to the processing of their personal data at any time, without affecting the lawfulness of processing based on consent before its withdrawal. The data subject also has the right to lodge a complaint with a supervisory authority.
14.5.
Providing the Customer's personal data is essential for the proper execution of the sales contract. Therefore, the Customer consents to the processing of their personal data by accepting these terms and conditions by clicking in the designated area. Failure to provide data or providing incorrect data may result in Tissushop cancelling the order.

Article 15 – Customer review
Each customer will have the opportunity to leave feedback on the ordered product by providing a rating and a comment visible to everyone. The review must therefore relate to a personal shopping experience of the reviewer, who must be associated with a customer account. The customer will need to log in to their customer account in order to leave a review.
Reviews submitted in this way will be moderated by Tissushop; reviews containing insults, defamatory, discriminatory, illegal, or morally offensive remarks, or deemed inappropriate by the moderator, will not be published.
Tissushop undertakes to remove any review at the express written request of the customer.
When a substantial feature of a Tissushop product is changed, it may delete and archive previous reviews relating to that product.
Tissushop is committed to holding a monthly prize draw among the published reviews ( based on the principle of one review = one chance to win) in order to award a gift card worth €30 (thirty euros) and to notify the winner by email to the customer account address.
Article 16 – Non-waiver
Tissushop's failure to enforce any right or provision of these Terms and Conditions shall not be construed as a waiver of such right or provision.
Article 17 - Translation
In the event of any difference in interpretation of these General Terms and Conditions of Sale, between the French version and the English version, the original French text shall prevail in all circumstances.
Article 18 - Intellectual Property
The content of this website is the property of Tissushop and is protected by French and international intellectual property laws. Any reproduction, in whole or in part, of its content is strictly prohibited and may constitute an infringement of copyright.
Article 19 - Disputes, mediation
In the event of a dispute between the business and the consumer, they will endeavor to find an amicable solution. If no amicable agreement can be reached, the consumer has the option of contacting the consumer mediator responsible for the business, namely the Association of European Mediators (AME CONSO), free of charge, within one year of the written complaint sent to Tissushop. The consumer mediator must be contacted: - either by completing the form provided for this purpose on the AME CONSO website: www.mediationconso-ame.com; - or by mail addressed to AME CONSO, 197 Boulevard Saint Germain – 75007 PARIS.
Article 20 - Applicable Law
These Terms and Conditions are governed by French law, excluding the provisions of the Vienna Convention. This applies to both substantive and procedural rules. In the event of a dispute or complaint, the Customer should first contact Tissushop to seek an amicable solution. Failing that, the Customer may initiate proceedings before the court of their choice, if they are a consumer.
